Thémis accompanies the managing director upstream from the time of the negotiation and drafting of the type of contract which is adapted to its needs and which applies under law (fixed term contracts, permanent contracts, full or part-time) in the negotiation of its ordinary clauses (classification, company benefits which apply) and specific clauses (training, noncompetition, confidentiality, intellectual property…) and drafts the contract.

In the case of a conflict, Thémis also assists the managing director in deciding whether and how to implement his disciplinary prerogatives, by consulting him regarding the possible measures which can be adapted to each situation.

When difficulties are encountered in the execution of the employment contract, the attorney is the employer’s daily intermediary due to his willingness to listen, and seek and implement practical advice adapted to each situation.

These difficulties can often be prevented by drafting the appropriate legal documents, which lend a framework to the employees’ tasks and their financial consideration and time-off (employment contract and job description, summary time sheet), contribute to the training of the employees (internal regulations), inform the employees, or prevent risks (single document for evaluating professional risks…) or lastly see to the employer’s successful communication with his teams (preparation of the annual individual evaluation meeting…).

Lastly, in the last resort, the firm is able to advise and assist the chief executive in implementing the procedures for termination of the employment contract, by drafting the legal documents (dismissal procedures, conventional termination, early termination of limited term contracts, settlements…) including in the case of the collective restructuring of the company and the performance of the mandatory formalities.
